Public offer

General provisions

This public offer (hereinafter referred to as the ‘Offer’) is addressed to individuals and legal entities and is an official offer of the Ukrainian Centre for International Partnership (hereinafter referred to as the ‘Organisation’), acting on the basis of the Charter, to conclude a charitable donation agreement on the terms and conditions set out below.

Terms and definitions

  1. Offer means a proposal of the Organisation to make a voluntary charitable donation posted on the website www.ukrainian.run (hereinafter referred to as the ‘Website’).
  2. Acceptance of the offer (Acceptance) means full and unconditional acceptance of the terms of this Offer by the user of the Site (hereinafter referred to as the ‘Benefactor’). Acceptance is carried out by the Benefactor taking actions aimed at transferring funds in the form of a voluntary donation.
  3. Charitable donation is a free-of-charge transfer of funds by the Donor under the terms and conditions specified in this Offer to achieve the goals set out in the Charter of the Organisation, in particular, to help, among others, internally displaced persons and veterans affected by the war in Ukraine, but not limited to.

Subject of the Offer

  1. The subject of this Offer is a gratuitous transfer of funds by the Benefactor to the ownership of the Organization to achieve the charitable purposes provided for by the statutory activities of the Organization.
  2. The benefactor determines the amount of the voluntary donation independently.
  3. The Offer shall be deemed accepted after the funds are credited to the Company’s account or after receiving confirmation of the transaction from the payment system.

The procedure for concluding an agreement

  1. The charitable donation agreement between the Donor and the Organisation shall be concluded by accepting the Offer, i.e. by the Donor taking actions that confirm his/her intention to make a donation through the Website functionality using payment cards and payment systems.
  2. By taking actions to make a donation, the Donor confirms his/her agreement with the terms of the Offer and his/her legal capacity.

Use of donations

  1.  The Organisation uses all funds received from the Donors exclusively for charitable purposes provided for in the Organisation’s Charter, in particular, to help internally displaced persons and veterans affected by the war in Ukraine, but not limited to.
  2. The Organisation has the right to use donations to cover the necessary administrative expenses related to the provision of assistance, if it is in line with the statutory activities and provided for in the expenditure plan.
  3. In the event that more funds are raised as a result of charity fundraising than the budget of a charity project, the balance will be used to finance the next project or other charity projects of the Organisation.
  4. If the donor has transferred a charitable donation more than the charitable project requires, the excess will be redistributed among other charitable projects of the Organisation.
  5. If the charity collection results in an amount less than the planned budget, the project will be implemented to a lesser extent.
  6. If, as a result of the implementation of a charity project, part of the budget is not used, the balance will be redistributed among other projects.

Rights and obligations of the parties
1. The Organisation undertakes to use the donations received from the Donor solely within the framework of its statutory activities and the purposes provided for in this Offer.
2. The Donor agrees that the donation made by him/her is voluntary, non-refundable and does not entail any obligations on the part of the Organisation.
3. The Donor has no right to demand from the Organisation to report on the use of funds on an individual basis, but the Organisation undertakes to publish general reports on its activities and the use of funds raised on the Website.
4. The Donor agrees that the amount of the donation is non-refundable.
5. A donor who makes a donation to a specific project agrees to redistribute/use it in other projects (for example, if the fundraising is closed or irrelevant).

Confidentiality and protection of personal data

  1. The Organisation undertakes to maintain the confidentiality of the Donor’s data received in the process of making a donation.
  2. The Donor’s personal data shall be processed in accordance with the laws of Ukraine and used solely to ensure the implementation of relations with the Donor under this Offer.

Final provisions

  1. This Offer is governed by the laws of Ukraine.
  2. The Organization reserves the right to make changes to the terms of the Offer at any time, and the changes shall take effect from the moment they are published on the Website, unless otherwise provided by the terms of the Offer.
  3. This Offer comes into force from the moment it is posted on the Website and is valid until withdrawn by the Organisation.
  4. In case of any questions, the Benefactor may contact the Organisation using the contact details indicated on the Website.
